These Terms & Conditions set forth the legally binding terms and conditions for your use of the website and our accommodation services.

Recitals:

Secret Patio Lisbon is a boutique hotel offering accommodation in private rooms, shared dormitories, and a suite, located at R. Fernandes Tomás 64, 1200-177 Lisboa, Portugal, steps from the Chiado and Bairro Alto neighbourhoods.

Rooms and accommodations can be reserved via our website www.secretpatiolisbon.com or through our direct booking engine.

1. Acceptance of Terms

By making a reservation and/or using our services in any manner, including but not limited to visiting or browsing the website, the guest agrees to these Terms & Conditions and all other operating rules, policies and procedures that may be published from time to time on the website by Secret Patio Lisbon, each of which is incorporated by reference and each of which may be updated from time to time without notice.

Certain services may be subject to additional terms and conditions specified by Secret Patio Lisbon; the use of such services is subject to those additional terms and conditions, which are incorporated into these Terms & Conditions by this reference.

These Terms & Conditions apply to all guests and users of the website and services.

2. Eligibility

Our accommodation services are available exclusively to individuals of full legal age (18 years or older) and with full legal capacity. By making a reservation, the guest declares that they are at least 18 years old and have full legal capacity to enter into a binding agreement.

Secret Patio Lisbon may, at its sole discretion, refuse to offer services to any person or entity and change its eligibility criteria at any time.

3. Reservations & Booking

To complete a reservation, guests must provide:

  • Personal details (full name, email address, phone number)
  • Valid identification (passport or national ID)
  • Valid means of payment

Secret Patio Lisbon may either reject or accept any reservation request at its sole discretion. Acceptance of a booking constitutes a binding contract between the guest and Secret Patio Lisbon.

Guests are solely responsible for ensuring that all information provided during the booking process is accurate, complete, and up to date.

4. Rates & Payment

All rates are quoted in Euros (€) and include applicable taxes unless otherwise stated. Payment is required at the time of booking or upon check-in, as specified in the individual booking conditions.

Secret Patio Lisbon reserves the right to modify rates at any time without prior notice. Rate modifications will not affect confirmed bookings.

In the event of non-payment or a failed payment, Secret Patio Lisbon reserves the right to cancel the reservation and claim any outstanding amounts.

5. Cancellation & Refund Policy

Cancellation policies vary depending on the rate type selected at the time of booking:

  • Flexible rate: Free cancellation up to 48 hours before the scheduled check-in date. Cancellations made less than 48 hours prior to arrival or no-shows will be charged the first night’s rate.
  • Non-refundable rate: No refund will be issued in the event of cancellation, modification, or no-show. The full booking amount will be charged at the time of reservation.

In the event of exceptional circumstances beyond the guest’s control (force majeure), Secret Patio Lisbon will review cancellation requests on a case-by-case basis.

6. Check-in & Check-out

Standard check-in time is 15:00 (3:00 PM) and standard check-out time is 11:00 (11:00 AM). Early check-in and late check-out are subject to availability and may incur additional charges.

Guests are required to present a valid photo ID at check-in. Secret Patio Lisbon reserves the right to refuse check-in to guests who are unable to provide valid identification.

7. Guest Conduct & House Rules

As a condition of stay, guests agree not to use the property or services for any purpose prohibited by these Terms & Conditions or applicable law. Guests are responsible for all activities conducted during their stay.

Guests shall not:

  • Cause damage to the property, furnishings, or any part of the premises
  • Create excessive noise or disturbances that affect other guests or neighbours
  • Bring pets onto the premises without prior written authorisation
  • Smoke in any indoor area of the property (designated smoking areas may be available)
  • Host unauthorised visitors or allow non-registered guests to sleep on the premises
  • Engage in any illegal activity on the premises
  • Use or distribute controlled substances on the premises

Secret Patio Lisbon reserves the right to immediately terminate the stay of any guest who violates these rules, without refund.

8. Content & Intellectual Property

All content on this website, including but not limited to text, photographs, videos, graphics, and logos, is the property of Secret Patio Lisbon or its licensors and is protected by applicable intellectual property laws.

Guests are granted a limited, non-exclusive, non-transferable licence to access and use the website content solely for the purpose of making and managing their reservation. Any other use, including reproduction, distribution, or commercial exploitation, is strictly prohibited without prior written consent.

9. Liability Limitations

Secret Patio Lisbon accepts no liability for damages or loss arising from the direct or indirect use of the website or our services, except where liability arises under mandatory Portuguese law for damages due to intentional acts, gross negligence, personal injury, or breach of essential contractual obligations.

Guests are solely responsible for their personal belongings. Secret Patio Lisbon does not accept liability for the loss, theft, or damage of personal property on the premises, except where such loss results from negligence on our part.

Secret Patio Lisbon shall not be liable for any failure or delay in performing obligations under these Terms & Conditions where such failure or delay is caused by events beyond its reasonable control (force majeure), including but not limited to acts of God, natural disasters, strikes, or government actions.

10. Privacy & Data Protection

11. Right of Withdrawal

Where applicable under Portuguese consumer protection law (Decreto-Lei n.º 24/2014), guests who book online have the right to withdraw from the contract within 14 days of booking, without giving any reason, provided the check-in date falls after the withdrawal period has expired.

To exercise the right of withdrawal, guests must notify Secret Patio Lisbon of their decision to withdraw by sending a clear statement to:

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of Portugal. Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

For the resolution of consumer disputes, guests may also use the Portuguese National Alternative Dispute Resolution entity (CNIACC) or access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Modifications

Secret Patio Lisbon reserves the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon publication on the website. Continued use of the website or our services following any changes constitutes acceptance of the revised Terms & Conditions.
